In accordance with the provisions of the Federal Law on the Protection of Personal Data Held by Private Parties ("LFPDPPP"), and its Regulations ("RLFPDPPP"), EQUYTON GROUP, S.A.P.I. de C.V., treats the personal data of individuals using the services of EQUYTON GROUP strictly confidentially. Therefore, the obtaining, processing, transfer, and exercise of the rights derived from the aforementioned personal data are done through proper, legitimate, and lawful use, permanently safeguarding the principles of legality, consent, quality, information, proportionality, and responsibility.

DEFINITIONS.

The terms used in this Privacy Notice with an initial capital letter will have, for all legal purposes of this notice, unless the context requires otherwise, the meaning attributed to them below:

EQUYTON GROUP Privacy Notice: This privacy notice for personal data.

Personal Data: The information that, including but not limited to, is listed below:

  • Full name;

  • Date of Birth;

  • Address;

  • Email address;

  • Landline;

  • Mobile phone;

  • Personal references.

Mexico: The United Mexican States.

Holder of Personal Data or Holder: The person who provides or delivers their personal and/or sensitive information.

EQUYTON GROUP: The commercial company named EQUYTON GROUP, S.A.P.I. de C.V., duly constituted in accordance with the laws of the United Mexican States.

PURPOSES AND TRANSMISSION OF PERSONAL DATA.

More than a policy, at EQUYTON GROUP we have the philosophy of maintaining a close and active relationship with people interested in using the services of EQUYTON GROUP.

Therefore, by voluntarily and directly providing your Personal Data, it will be guaranteed to be processed in Mexico, directly through EQUYTON GROUP, its subsidiaries, affiliates, related parties, or business partners, as well as, if applicable, with the competent authorities, for the following purposes:

  • Responding to information requests about our services;

  • Carrying out services by EQUYTON GROUP;

  • Fulfilling obligations contracted with our clients;

  • Informing about changes in EQUYTON GROUP's products or services;

  • Evaluating the quality of the service provided;

  • Contacting the Holder to inform them about the status and/or result of the Services, as well as to request additional information or provide information about EQUYTON GROUP;

  • Complying with legal requirements;

  • Managing the sending of communications with notices, messages, news, invitations to events and meetings, whether through printed, electronic, telephone, and/or in-person means for compliance and quality purposes of the Services, advertising, promotional, commercial prospecting, or marketing purposes, unless you expressly state your wish not to receive them;

  • Keeping EQUYTON GROUP's records updated to respond to the Holder's inquiries, invite them to events, maintain general communication, and follow up on our commercial relationship; and

  • To prevent unauthorized access to your Personal Data and to ensure that the information is used for the purposes established in this EQUYTON GROUP Privacy Notice, we have implemented physical, electronic, and administrative procedures using advanced technologies that limit the use or disclosure of your data, allowing us to properly process them and prohibiting the extraction of any information containing Personal Data from EQUYTON GROUP's offices or from the work tools (mobile devices) provided to Advisors.

PERSONAL DATA AND REVOCATION OF CONSENT (ARCO REQUEST).

All your Personal Data is treated in accordance with the applicable and current legislation in Mexico. Therefore, we inform you that you have the right at any time to access, rectify, cancel, or oppose the processing of your Personal Data, as well as to revoke the consent granted for its processing; a right that you can exercise by submitting an ARCO request to:

The ARCO request (access, rectification, cancellation, and/or opposition), referred to above, must contain and accompany the following information:

  • The name of the Holder and address or another means to communicate the response to your request;

  • The documents that prove the identity or, where appropriate, the legal representation of the Holder;

  • A clear and precise description of the personal data for which you seek to exercise any of the aforementioned rights; and

  • Any other element or document that facilitates the location of the personal data.

Through these channels, you can update your Personal Data and specify the means by which you wish to receive information. If this specification is not provided by you, EQUYTON GROUP will establish the channel it deems appropriate to send you information.

Data Collection while Browsing EQUYTON GROUP Websites.

EQUYTON GROUP may collect personal data through its websites or by using automatic data capture tools. Among the automatic data capture tools used by EQUYTON GROUP on its websites are cookies, web beacons, and links in emails.

Use of Web beacons.- Also known as Internet tags, pixel tags, and clearGIFs - EQUYTON GROUP may use web beacons on its websites and in its HTML-formatted emails, alone or in combination with cookies, to collect information about the use of our websites and your interaction with the email. The web beacon is an electronic image, called a single-pixel (1x1) or GIF, that can recognize information processed on your computer, such as cookies, the time, and date the site and its sections are viewed.

Links in EQUYTON GROUP Emails.- Emails that include links that allow EQUYTON GROUP to know if you have activated such a link and visited the destination web page, and this information may be included in your profile.

TRANSFER OF PERSONAL DATA.

EQUYTON GROUP may transfer your Personal Data to domestic or foreign third parties for the following purposes:

  • When requiring a third party for a service or advice regarding the moral and/or financial solvency of the Holder of Personal Data, including investigation of credit bureau, assets, values, and debts thereof.

  • When requiring a third party for a service related to the services provided by EQUYTON GROUP.

  • When, where appropriate, it is required by the service providers with whom EQUYTON GROUP has a business relationship.

  • When, for any reason, as a consequence of providing the Services, EQUYTON GROUP needs to contact and/or notify any type of information to the Holder of Personal Data.

VALIDITY.
